In-Depth Driving Under the Influence, the Science and the Civil Liberties issues

Mark Reinhardt- Boise Idaho

Within the years prior to 9/11, Driving Under the Influence of Alcohol has long been a subject of Public Safety Concern within communities across the country. The main focus, being impaired driving.
To better understand the science behind Driving Under the Influence of Alcohol. Its important to have some context.

Alcohol is absorbed into the lower Intestine, with differing affects on the body, depending upon the concentration in the system. Food, is often used to keep alcohol in the stomach, lessening affects of how its absorbed into the human body. 90% of the Alcohol consumption is absorbed by the liver. The measurement of how drunk someone is, is known as BAC, or Blood Alcohol Content.

Post 9/11, issues related to driving under the influence has crossed into issues relating to Civil Liberties across the country.
Within the State of Idaho, traffic stops related to Drunk Driving are under the doctrine of Implied Consent, to which the Idaho State Police writes;
DUI Prevention Implied Consent 1

In a report issued by KBOI 2, a State Trooper interviewed for the story mentioned that people feeling buzzed, should take a cab home, or have someone pick you up as a general safety tip.

Editorial: My response to the Salon.com piece about victims of Doxxing

Mark Reinhardt- Boise Idaho

Salon.com has recently issued a piece regarding a young woman who was a victim of Doxxing. This practice involves taking someones image of an intimate nature and spreading it around the internet for the purposes of humiliation.
http://www.salon.com/2014/03/02/doxxing_victim_this_isn%E2%80%99t_about_porn_this_is_about_humiliation/

First and foremost, I am not ok with this practice, and personally believe that men who engage in this behavior are immature children.

That being said, there are common sense pre-cautions that you can take avoid being a victim
1. If you don’t want that image spread, don’t click send on that email.
When you click send on an email, you are giving consent to the other person along with any attachments associated with that email.

2. I will be addressing a tweet that was issued in response to number one.

Hacking is the Digital Equivalent of “Breaking and Entering” and is not an action of consent, it is an action of theft. Which is also an act of agression on part of the person engaging in such activities.Taping over your Smartphone and Web camera’s is the best practice in protecting yourself from the hacking issue involved in such actions.

There are already plenty of laws on the books that address the issue of Hacking, in fact, as Cornell University Law School notes;
U.S. Code › Title 18 › Part I › Chapter 47 › § 1029
18 U.S. Code § 1029 – Fraud and related activity in connection with access devices
(a) Whoever—
(1) knowingly and with intent to defraud produces, uses, or traffics in one or more counterfeit access devices;
(2) knowingly and with intent to defraud traffics in or uses one or more unauthorized access devices during any one-year period, and by such conduct obtains anything of value aggregating $1,000 or more during that period;
(3) knowingly and with intent to defraud possesses fifteen or more devices which are counterfeit or unauthorized access devices;
(4) knowingly, and with intent to defraud, produces, traffics in, has control or custody of, or possesses device-making equipment;
http://www.law.cornell.edu/uscode/text/18/1029
Other examples include Extortion, Blackmail, among others.

Granted, the laws related to unauthorized computer access differs from Country to Country. This is why taking measures to protect yourself is a must.

While I am deeply sorry that this has happened. I am not in favor of new laws regulating the Internet. However, people who are victims can contact ic3.gov.

According to the Idaho Department of Water Resources, 13,000 Gallons a day equals out to 4,745,000 Gallons a year, which equals to 14.6 Acre Feet when talking about land usage.

In-Depth: Ongoing Water Resource issues creating conflict in Idaho

Mark Reinhardt- Boise Idaho

At a joint hearing of the Idaho House Energy, Resources, and Environment Committee, the Idaho Water Board discussed water resource shortages within the State, among which, was the water resource shortage at Mountain Home Air Force Base.

According to reports by the AP, a Water Call was issued by the Water Resources Department for South Central Idaho. The article states,

Fact Check: Is Idaho SB 1337 an Ag-Gag Law?

Mark Reinhardt- Boise Idaho

At a hearing of the Idaho State Senate Affairs Committee, closing statements were issued on a bill title SB 1337. The Bill itself would prohibit recordings at Agricultural Facilities.
Idaho SB 1337

Click to access S1337.pdf

At the hearing, this is what Legislators said about the bill;

Described as an Ag-Gag Law, activist group Mercy for Animals had asked that residents of Idaho oppose the bill, citing new video released by them,

Federal Case law however, has already made it standard jurisprudence in First Amendment related cases. As the Reporters Committee for Freedom of the Press writes;
Journalists who lie on employment applications to gain access to private facilities for newsgathering activities are not protected by the First Amendment and may be liable for trespass or other offenses, a federal appellate court ruled more than a dozen years ago in a ruling that remains the leading case on the issue. – See more at: http://rcfp.org/browse-media-law-resources/news-media-law/news-media-and-law-spring-2012/landmark-food-lion-case#sthash.YWzfOCmf.dpuf

The RCFP further writes of the 4th Circuits decision;
The Fourth Circuit in Food Lion, Inc. v. Capital Cities/ABC, Inc. rejected the fraud damages because it found that the grocery chain failed to prove it suffered any injury as a result of its reliance on the misrepresentations the producers made on their job applications. – See more at: http://rcfp.org/browse-media-law-resources/news-media-law/news-media-and-law-spring-2012/landmark-food-lion-case#sthash.YWzfOCmf.dpuf

SB 1337 has been reported to have left committee with a Due Pass recommendation and is currently awaiting second reading.

Editorial: A Epic Aspie Rant on Kids with Autism and Tracking Devices

Mark Reinhardt- Boise Idaho

Let me start off with a disclosure:
I have Aspergers, so, I will be issuing this editorial from this stance primarily and highlight my reasonings on things related to this.

I would like to thank Disability Scoop for the work that they do in addressing Disability Issues that the media consistently fails to address. This being said, I have to take Disability Scoop and the parents in the following articles comment section to task.

There are many levels of functioning people fail to take into account when they talk about devices or measures to keep track of their children.

For example, I have Aspergers and I like my Constitutional Rights and all the things those persons without Disabilities enjoy. Though, having seen the potential benefits of what these devices can do. I have to address a quote from United States Attorney General Holder;
“I think that given the nature of the unique issues that kids with autism issues face and given the way in which our nation has responded to adults with Alzheimer’s issues, that they ought to be treated in much the same way.”

No Attorney General Holder, there are unique differences between the two.

From the National Institutes of Health:
“Autistic disorder (sometimes called autism or classical ASD) is the most common condition in a group of developmental disorders known as the autism spectrum disorders (ASDs).
Autistic children have difficulties with social interaction, display problems with verbal and nonverbal communication, and exhibit repetitive behaviors or narrow, obsessive interests. These behaviors can range in impact from mild to disabling. Autism varies widely in its severity and symptoms and may go unrecognized, especially in mildly affected children or when more debilitating handicaps mask it. Scientists aren’t certain what causes autism, but it’s likely that both genetics and environment play a role.”

I happen to have Aspergers, and this is what NIH has on that;
“Asperger syndrome (AS) is an autism spectrum disorder (ASD), one of a distinct group of complex neurodevelopment disorders characterized by social impairment, communication difficulties, and restrictive, repetitive, and stereotyped patterns of behavior. Other ASDs include autistic disorder, childhood disintegrative disorder, and pervasive developmental disorder not otherwise specified (usually referred to as PDD-NOS).”

Here is NIH definition on Alzheimers:
“Alzheimer’s disease is an irreversible, progressive brain disease that slowly destroys memory and thinking skills and, eventually even the ability to carry out the simplest tasks of daily living. In most people with Alzheimer’s, symptoms first appear after age 60. Alzheimer’s disease is the most common cause of dementia among older people.”
http://www.nia.nih.gov/alzheimers/topics/alzheimers-basics

So, as the National Institutes for Health rightly point out. There are BIG differences between the two.

It should be pointed out that even Policeone.com knows the difference between High Functioning Autism, and lower functioning versions;
http://www.policeone.com/response/videos/5956254-Autism-Recognition-and-Response/

Aspergian Communication and the activist elements amongst persons with Aspergers:
It should be noted that some persons with Aspergers use analogies in communication with people in the everday world. I am one of these.

I will now bring to your attention, something that I have thought about for a long time.
The Aspergian Activist movements:
These groups are known as, “Aspies for Freedom, and the “Autie Liberation Front”
Groups that were originally started due to this particular item from Autism Speaks;

http://www.cafepress.com/autieliberation.107371420
http://www.aspiesforfreedom.com/

I am all for Disability Advocacy and Activism, but this pushing it too far, and I will tell you why.

1. Guardianship:
Guardianship is a section of state laws designed to protect the rights of persons with Disabilities. However, this gets complicated when you throw money into the middle of the process. As Disability Rights Idaho writes;

The Idaho State Supreme Court had discussed care of persons with Developmental Disabilities;

I will address the obvious “Due Process” violations associated with the Guardianship Systems existence at a different time.

2. Disdain for what people do not understand
Its bad enough, I have to deal with ignorance on the issue of living with Aspergers, and having it compared to this “Not Funny” South Park joke;

A better Aspergers joke would read, “My brain is like a supercomputer, and my analysis indicates that your an idiot.”

Autism Speaks Fear Mongering;
While I still believe that any group that takes money from Goldman Sachs should immeadiately be suspect. I will talk about this group and why it shouldn’t be trusted outside of the obvious reason.

This group does not represent me and prays on the fears of parents who fear their children, because they don’t understand them, *cough* anarachistsoccermom *cough*
“My son Michael entered the juvenile justice system just one month after his eleventh birthday. While on probation, he received an array of social services including therapy and psychosocial rehabilitation, which taught him coping strategies. But once he completed probation, those services went away.”
http://anarchistsoccermom.blogspot.com/2013/03/after-newtown.html
Another Example (Different Person):

I agree that the quality of services is lacking, and that the end result is showing up on the Street Corner of Main and 6th at night. However, I have to say this to parents everywhere, including within the State of Idaho.
“Stop calling the cops on your kids. You are contributing to their path as a Career Criminal.”

This being said, I also have to say to those in the Idaho Legislature.

“If you want to avoid criminalizing Eleven Year olds, actually fund Medicaid by taxing the banks at .666 or Legalize Pot Completely.”
http://www.sungard.com/pressreleases/2013/financialsystems072313.aspx
^”Greater than 50 Nonillion.”

This way, persons with Disabilities are not treated like Cattle, the economy will improve, and we are out of the “so-called” Great Recession.
